This case alleges claims under state and federal consumer protection laws and for breach of contract. Plaintiffs are homeowners who obtained a mortgages, home equity loans or home equity lines of credit from Washington Mutual Bank or its subsidiaries and who were charged certain challenged fees when they re-paid their home loans prior to maturity, such as Fax Fees, Payoff Statement Fees or UCC-3 Fees. This case is certified as a class action against Washington Mutual, Inc. (WMI) and a settlement among the class and WMI has been approved by the United States District Court for the Eastern District of New York and affirmed by the Second Circuit Court of Appeals. Distribution of the settlement funds to claiming class members was made in December 2013
