The complaint filed by Tusa P.C. and its co-counsel against Select Portfolio Servicing (SBS) and its bank affiliates U.S. Bank and Bank of America alleges that SBS and its bank affiliates breached mortgage agreements, acted in bad faith and violated federal and state consumer protection and lending laws by (i) demanding the payment of late fees on loans that were accelerated due to a claimed default or foreclosure; (ii) adding repetitive and unreasonable inspection fees to loan balances; and (iii) charging inflated variable interest rates.
