This proposed class action alleges violations under New York laws that require banks to release their mortgage liens within 30-days of mortgage or home equity loan repayment and as a result engaged in breach of contract and deceptive practices. The case claims that U.S. Bank and its loan servicers Wells Fargo and Ocwen Financial (aka PHH Mortgage Corp.) did not present a “satisfaction of mortgage” or “certificate of discharge” to release the mortgage liens against the homeowner Plaintiffs' homes within 30-days of Plaintiffs' repayment.
