NCO Financial Systems and Law Firm Debt Collection Litigation

Case Name:   LaCourte v. NCO Financial Systems, Inc.

  • This case alleged that consumers were subjected to unlawful debt collection by NCO Financial Systems and Foster & Garbus LLP and other law firms hired by NCO Financial to sue consumers, often with the consumers' knowledge of NCO Financial's involvement in the lawsuits.  Included with Forster & Garbus among the other law firms retained by NCO Financial are Cohen & Slamowitz, LLP; Fulton Friedman & Gullace LLP; Kirschenbaum & Phillips, P.C.; Malen & Associates, P.C.; Mel. H. Harris & Associates, LLC; Mullooly, Jeffrey, Rooney & Flynn; Relin Goldstein & Crane LLP; Rubin & Rothman LLC; Sharinn & Lipshie, P.C.; Solomon & Solomon, P.C.; and Stephen Einstein & Associates, P.C.  Plaintiff alleged that NCO and its affiliate law firms commence lawsuits in the New York courts against consumers to collect debts that are not owed in whole or part (including debts that were settled) and for using deceptive, abusive or harassing collection methods. The case was filed as a putative class action in the United States District Court for the Southern District of New York and alleges claims for violations of the Fair Debt Collection Practices Act, New York General Business Law Section 349 and New York Judiciary Law Section 487.
