Amerix and Careone Credit Repair Litigation

  • This case is a class arbitration in the American Arbitration Association where Claimants and the class allege that the respondents violated the Credit Repair Organizations Act (CROA) and state consumer protection laws by providing credit repair services without complying with CROA's disclosure rules, the prohibition against payments before completion of the credit repair services and for making false, deceptive and misleading statements about debt management plans (DMPs) they sold or administered to consumers who sought credit counseling or debt relief assistance. 
  • The case was certified as a class arbitration.  After a final hearing, the Arbitrator found that Respondents including Bernaldo Dancel, Amerix and Careone Services violated CROA and the punitive damages would be awarded.   A settlement with prior respondents American Financial Solutions and North Seattle Community College Foundation has been finally approved by the arbitrator. A settlement with respondents Genus Credit Management Corp. and InCharge Institute of America has been has been preliminarily approved by the American Arbitration Association arbitrator.
